<p>The issue with open access and US universities is the 1980 Bayh-Dole Act giving universities ownership of the research. During the '80s (1) state legislatures started reducing support for higher education and we saw the rise of the tech transfer offices.
Increasingly, research outputs were patented and commercialized in support of the universities. Funding for the university will always come before open access.</p>
